Bank of America agreed to a $2.25 million class action settlement over ATM fees charged at certain 7-Eleven locations. If you held a Bank of America checking account and used an FCTI-operated ATM inside a 7-Eleven store between May 1, 2018, and November 16, 2021, you may qualify for a payout.

You qualify for this settlement if all of the following apply:
- You held a Bank of America checking account during the covered period.
- You used an ATM owned by FCTI, Inc. inside a 7-Eleven store between May 1, 2018, and November 16, 2021.
- You were charged more than one out-of-network balance inquiry fee during the same ATM visit.
- You did not receive a payment from the earlier Weiss v. FCTI, Inc. settlement, which was resolved in 2024.

Current Accountholders vs. Past Accountholders
Your required action depends on whether you still hold a Bank of America account today.
Current accountholders do not need to do anything. If the Court approves the settlement, you will automatically receive an equal pro-rata share of the Net Settlement Fund based on the number of current and past accountholders who submitted valid claims.
Past accountholders must submit a claim form to receive any payment. If you take no action as a past accountholder, you will receive nothing.
How to File a Claim (Step-by-Step)
Follow these steps if you are a past Bank of America accountholder who received a settlement notice.
Step 1: Locate your Class Member ID
Find the Class Member ID printed on the email or postcard notice you received. You need this ID to complete the online claim form.
Step 2: Go to the official settlement website
Visit the settlement website authorized by the Court. To submit a claim, click here.
Step 3: Fill out the Claim Form
Enter your Class Member ID and complete all required fields. If you prefer a paper form, download the Claim Form from the Documents section of the settlement website.
Step 4: Select your payment method
Online filers can choose either electronic payment or a paper check. If you do not select a payment method, the administrator will mail you a paper check. Paper Claim Forms pay by paper check only.
Step 5: Submit before the deadline
Submit your completed Claim Form by Monday, July 29, 2026. The administrator will not accept late submissions.

How Much Will You Receive?
The exact payout per person is not yet determined. All eligible settlement class members will split an equal share of the $2.25 million fund after the Court deducts attorney fees and administrative expenses.
The per-person amount depends on two factors: how many current accountholders are in the settlement class and how many past accountholders file valid claims. The more valid claims submitted, the smaller each individual share becomes.
Can You Opt Out or Object?
Opting out: If you submit an exclusion request by July 7, 2026, you give up your right to any settlement payment. In return, you keep the right to sue Bank of America separately over the same claims.
Objecting: You can file a written objection with the Court by July 7, 2026, if you believe the settlement is unfair. Filing an objection does not remove you from the settlement. You may also attend the Final Fairness Hearing on August 21, 2026, to speak to your objection, but you must first file a Notice of Intention to Appear.

Do I need to file a claim if I still have a Bank of America account?
No. Current Bank of America accountholders who received a settlement notice do not need to take any action. The administrator will automatically include you in the payout if the Court approves the settlement.
What if I never received an email or postcard notice?
Call the settlement administrator at (833) 447-8321 to confirm whether you are a class member. You may still qualify even if your notice went to a old email address or a previous mailing address.
Can I receive payment if I already got money from the Weiss v. FCTI settlement?
No. If you received a payment through the Weiss v. FCTI, Inc. settlement resolved in 2024, you are not eligible to receive any payment from this settlement.
What happens if I miss the July 29 claim deadline?
The administrator will not process late claim forms. If you are a past accountholder and miss the deadline, you will not receive any payment, even if you otherwise qualify.
When will payments actually go out?
Payments will not go out until after the Final Fairness Hearing on August 21, 2026, and only if the Court gives final approval. If anyone files an appeal after that hearing, payments may be delayed further until the appeal resolves.
